Can I appeal a Board's decision?
The Land and Property Rights Tribunal (formerly Municipal Government Board) or ISDAB may approve or reject an appeal. As such, the Land and Property Rights Tribunal or ISDAB may order a change, amendment, or add new conditions to the approval. The Land and Property Rights Tribunal or ISDAB must provide the reasons for its decision in writing.
The only avenue of appeal of the Land and Property Rights Tribunal or ISDAB decision is to file a leave to appeal application with the provincial Court of Appeal on a point of law or jurisdiction.
